a theoretical question?

 I want to defeat the efforts of those who do not want to be observed by
classified or commercial orbiting assets so I have come up with this
solution,

the idea is a fission powered spysat that would only orbit in earth shadow,
is it possible for a Molniya orbit that is only in darkness? and one last
thought, does the seesat community ever use infrared to attempt to observe
objects in darkness? My proposed spacecraft would be very warm :)

by the way  years ago  you folks kindly told me the orbit of the Mars
observer would never cross the earth orbit so as to not provide a visual
 observation opportunity   thanks!
